Superior Court Rules in BC's Favor in Exit Motion

Aug. 18, 2004

The Massachusetts Superior Court ruled in Boston College's favor Wednesday in its motion for summary judgment involving its exit from the Big East Conference. The court ruled that the October 6, 2003 amendment to the Big East Constitution was not adopted in accordance with the Constitution and is therefore invalid, and Boston College is entitled to withdraw from the Big East Conference on July 1, 2005 for an exit fee of $1 million. "We are gratified that, after nearly a year of adverse and misleading public statements leveled against us, a respected judge has seen through to the actual merits of the case and has ruled in favor of Boston College," Director of Athletics Gene DeFilippo says. "I would like to thank the University's attorney in the case, J.D. Smeallie of Holland and Knight, and University Counsel Joe Herlihy for their hard work."
